These terms and conditions (“Agreement”) are entered into by and between WebITHost (“Company”) and the customer (“Client”) using the Company’s web services. By signing up for or using our services, the Client agrees to be bound by these terms and conditions. This Agreement outlines the responsibilities and expectations of both parties regarding the use of WebITHost’s web services.

Services Provided

WebITHost agrees to provide web hosting services to the Client, including server space, bandwidth, and other related resources, as outlined in the selected hosting package.

Payment and Billing

  • The Client agrees to pay the fees associated with the selected hosting package or Forex VPS or Dedicated server or any other listed service as stated on the WebITHost website or as communicated through official correspondence.
  • Payments are to be made on the schedule specified during the order process. Failure to make timely payments may result in suspension or termination of services.
  • All fees are non-refundable once the services have been activated, except as otherwise specified in the WebITHost Refund Policy.
  • In the event that hosting services are suspended due to non-payment, WebITHost will store the client’s data in suspension mode for up to 30 days. The client may reactivate the services by settling the overdue invoice within this period. However, reactivation of services will not alter the original billing cycle. For example, if an invoice is due on the 15th of the month and payment is made on the 14th of the following month (a delay of 29 days), the next invoice will still be generated according to the original schedule, typically 2-3 days after the new billing cycle begins. WebITHost reserves the right to charge for storing data during the suspension period.
  • If an account is terminated, the client may request to retrieve their data within 7 days of termination. This service is provided at an additional charge of $10. After 7 days, WebITHost is not obligated to retain or recover any data associated with the terminated account.

Content and Usage

  1. The Client is solely responsible for the content uploaded and published on their website. Content must comply with all applicable laws and regulations, and must not infringe upon the rights of any third party.
    B. The Client agrees not to use the hosting services for any unlawful, prohibited, or harmful activities, including but not limited to distributing malware, engaging in spamming, or hosting illegal content.

Data Security and Backups

  1. WebITHost undertakes regular backups of hosted data; however, the Client is solely responsible for maintaining their own backups of important data.
    b. In the event of data loss, WebITHost will make reasonable efforts to restore data from the latest available backup, but cannot guarantee complete data recovery.

Service Availability

  1. WebITHost strives to maintain a high level of server availability, but downtime may occur due to maintenance, technical issues, or other reasons beyond our control.
    b. WebITHost is not liable for any losses or damages resulting from service interruptions.

24/7 Support

  1. WebITHost offers technical support to assist Clients with issues related to their hosting services.
    b. Support inquiries should be directed to the designated support channels provided by WebITHost.

Limitation of Liability

WebITHost is not liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the services provided.

Cancellation & Termination

  1. Either party may terminate this Agreement with written notice.
    b. WebITHost reserves the right to suspend or terminate services immediately, without notice, for any violation of these terms and conditions.

No Spam Policy

WebITHost maintains a strict “No Spam” policy. Clients using our services are prohibited from engaging in spamming activities, including sending unsolicited emails, bulk emails, or any other form of electronic communication that violates anti-spam laws and regulations. Violation of this policy may result in immediate suspension or termination of services.

Trademark and/or Copyright Claims

WebITHost respects the intellectual property rights of others. If you believe that your trademark or copyright has been infringed upon by content hosted on our servers, please notify us promptly. WebITHost will investigate the claim and, if necessary, take appropriate action to remove or disable access to the infringing material.

Domain Registration

It is the responsibility of the client to verify the successful registration of a domain. In case of any issues with domain registration, the client must contact WebITHost within 7 working days by emailing support@cheapforexvps.net to rectify the problem. WebITHost accepts no liability for failed domain registrations due to invalid/insufficient information, late payments, or technical faults beyond our control.

Prohibited Content

Customers must use WebITHost’s services for lawful purposes only. The following content is strictly prohibited on our servers and network:

  • Anything related to IRC
  • Proxy Scripts
  • Downloading websites for copyrighted content (e.g., music, media, movies, software) on Linux shared hosting and Linux Reseller hosting plans
  • Anything related to torrents
  • Starting background processes on shared servers
  • Warez, hacking tools, exploits
  • Sites promoting illegal activities
  • IP Scanners
  • Hacker-focused sites

Accounts found in violation of copyright or engaging in prohibited content will be removed, and access to the material may be disabled. Repeated violations of copyright laws may lead to suspension or termination of hosting services.

Data Protection and Security

Customers are responsible for maintaining the security of their accounts and websites. Backups should not be stored on WebITHost’s servers. Customers should keep their accounts and plugins up to date, use strong passwords, and maintain their own backups. WebITHost is not liable for any site hacks, malware attacks, virus uploads, unauthenticated logins, or data loss.

By using WebITHost’s services, the client agrees to abide by these terms and conditions. This Agreement constitutes the entire understanding between Yash Host and the client, superseding all prior agreements.

Changes to Terms

WebITHost reserves the right to modify these terms and conditions at any time. The Client will be notified of significant changes via email or through the WebITHost website.

By using WebITHost’s services, the Client acknowledges that they have read, understood, and agreed to abide by these terms and conditions. This Agreement constitutes the entire agreement between WebITHost and the Client and supersedes all prior agreements and understandings.
